On August 5, 1919, by the decision of the Council of Ministers of the People's Republic of Azerbaijan, the Labor Inspectorate was established under the Ministry of Labor to regulate labor protection, wage rates and labor disputes. With the establishment of the inspectorate, labor protection control was concentrated in one department, and its sphere of control covered the entire territory of the republic.
A district inspector operated in each of the 8 regions of the country. The resolution of the People's Republic of Azerbaijan Parliament "On the Labor Question" dated December 7, 1918, determined the provision of insurance to workers in case of full or partial loss of working capacity.
After Azerbaijan regained its state independence in the early 90s, the reorganization of state institutions began. On January 27, 1997, the State Labor Inspectorate (SLI) was established under the Ministry of Labor and Social Protection of the Population. In 2011, the State Labor Inspectorate Service (SLIS) under the Ministry of Labor and Social Protection of the Population (MLSP) was established on the basis of the SLIS.
By Decree No. 386 of the President of the Republic of Azerbaijan dated February 16, 2011, the “Regulations on the State Labor Inspectorate Service under the Ministry of Labor and Social Protection of the Population of the Republic of Azerbaijan” were approved.
SLIS is an executive authority that exercises state control over compliance with the requirements of the Labor Code and other normative legal acts included in the labor legislation system by legal entities operating in the country, branches and representative offices of foreign legal entities, and individuals (employers), regardless of their ownership and organizational-legal form.
When fulfilling its duties and exercising its rights, the Service directly and within its powers interacts with central and local executive authorities, trade unions, employers' associations, local self-government bodies, as well as international and non-governmental organizations. The Service has an independent balance sheet, state property at its disposal in accordance with the legislation, treasury and bank accounts, a seal with the image of the State Emblem of the Republic of Azerbaijan and its name engraved on it, relevant stamps and forms.
The Service participates in the development of state policy in the field of state control over compliance with labor legislation.
The State Labor Inspectorate Service carries out state control in the field of compliance with labor legislation, including the regulation of labor relations with employees on the basis of an employment contract (contract), payment of labor, ensuring the right to vacation and rest, labor protection, technical safety, working conditions, payment of payments in connection with labor injuries, certification of employees and workplaces, compulsory insurance of employees against loss of professional working capacity as a result of industrial accidents and occupational diseases, compliance with labor and labor protection requirements in the work process (working hours, labor safety, labor hygiene, use of labor of women, disabled people, persons under the age of 18, etc.) and in other areas in accordance with the requirements of labor legislation, raises issues with the relevant state bodies for bringing to administrative responsibility and other liability persons guilty of violating labor legislation in cases and in the manner established by the Code of Administrative Offenses of the Republic of Azerbaijan, and at the same time provides methodological assistance to employers and employees on the application of labor legislation.
The Service's apparatus, regional departments, the Labor Protection Center and the State Labor Inspectorate Service of the Nakhchivan Autonomous Republic form a single system of the State Labor Inspectorate. The Service is headed by the Head of the Service, who is appointed and dismissed by the Minister of Labor and Social Protection of the Population of the Republic of Azerbaijan.
There are three deputies, who are appointed and dismissed by the Minister of Labor and Social Protection of the Population of the Republic of Azerbaijan on the basis of the presentation of the Head of the Service. The heads of regional divisions of the State Labor Inspectorate are appointed and dismissed by the Minister of Labor and Social Protection of the Population on the basis of the presentation of the Head of the Service.
Currently, the Service employs 195 inspectors (including those in managerial positions). 140 of them are men and 55 are women.
